Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Phoney mobile application and related services (collectively, the "Service"), operated by Stav Ashuri ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Phoney is an AI-powered phone call automation service. You provide task details (such as appointment information, phone numbers, and instructions), and Phoney places phone calls on your behalf using artificial intelligence to conduct the conversation. The Service processes the call in real time and reports the outcome back to you.

2. Eligibility

You must be at least 18 years old to use the Service. By using Phoney, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

To use the Service, you must create an account using a valid email address and password, or by signing in through Google or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

The Service, including its design, features, code, and content (excluding user-provided data), is the property of Stav Ashuri and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

The Service relies on third-party providers for telephony (Twilio), AI processing (Anthropic), speech processing (Deepgram), authentication (Google, Apple), and hosting (AWS). We are not responsible for the availability, performance, or policies of these third-party services. Your use of the Service is also subject to the terms and policies of these providers.

12. Feedback and Service Improvement

The Service includes optional features that allow you to submit feedback about your experience, including free-text comments and screenshots. When you choose to submit feedback, you grant us permission to review the submitted feedback along with associated data from the related task — including task details you provided, the call transcript, and the call outcome — solely for the purpose of improving the Service.

Submitting feedback is entirely voluntary. You may use the Service without ever submitting feedback. Feedback data is reviewed only by our internal team and is never sold, shared with third parties, or used for advertising purposes. Our collection and use of this data is described in our Privacy Policy.

13. Modifications to Terms

We may revise these Terms at any time by posting the updated version on the Service. Material changes will be communicated through the app or by email. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
